Arrested Persons Now Get Released In California Without Having To Pay Bail.

Axel Bail Bonds assist people get out of jail using all avenues, to include, property bonds. Instead of paying thousands of dollars in bail money, property owners can now sign for the release of detainees. We are probably the most experienced company in using Penal Code 1298 in the State of California. We have assisted attorneys and their clients in practically all the different counties in the State of California, both in State and Federal Courts.

Under the law, all persons arrested are innocent until proven guilty, however, to guarantee that they will not flee and show-up to court has traditionally asked for a guarantee commonly referred to as bail. For many years, there has been a law in California, Penal Code 1298, which allows the owner of a home to sign someone to be released from custody.

What is Penal Code 1298? Penal Code 1298 says that equity in a home can be used to guarantee the presence of defendants in court. The equity is accepted by the Superior Court at half its value towards the bail. So for example if a defendant is given a $100,000 bail and he has a relative or friend willing to sign for his release and the home has $200,000 in equity, then the defendant avoids having to pay a bail bond agency a $10,000 premium.

The approach in each jurisdiction varies, which has a tendency to confuse as to what are the actual needed documents. Some counties make it a relatively simple process; others make people and their attorneys shy away from using Penal Code 1298. Axel Bail Bonds through affiliates and resources has made this process easy and been very successful in helping families and their attorneys to post property bonds. In order to prove the equity in the home an appraisal from a licensed appraiser is required.

In simple terms, the signer (property owner) presents a current appraisal and Title Report not older than 10 days to the Court. The challenge of getting appraisals sometimes is a two-week process, and getting appraisers to call you back is almost impossible. We have fine tune this process throughout the state with key personnel to expedite release.

Do I need collateral to bail out of jail?
